Terms of service

These terms are an agreement between you and Octernix, which runs Pingodra. By creating an account you accept them. If you use Pingodra for a business, you accept them on that business's behalf.

What Pingodra does

Pingodra lets you import contacts from a Google Sheet and send them WhatsApp messages from your own WhatsApp Business number, using Meta's official WhatsApp Business Platform. You connect your own number and are responsible for your Meta account.

Your responsibilities

  • Only message people who opted in. Every contact you import must have agreed to receive WhatsApp messages from your business. You must be able to show that consent if asked.
  • Honour opt-outs. Don't re-add people who asked to stop hearing from you.
  • Follow the WhatsApp Business Messaging and Commerce Policies, Meta's terms, the DPDP Act, TRAI rules and all other laws that apply to you.
  • Don't send spam, scams, illegal content, or content WhatsApp prohibits.
  • Don't upload contact lists you bought, rented or scraped.
  • Keep your login details and Meta credentials safe. You're responsible for activity on your account.

For your contacts' personal data, you are the data fiduciary and we process it on your instructions, as our privacy policy explains.

Plans and payment

  • Plans are prepaid for 30 days and don't renew automatically. Prices are in Indian rupees.
  • Each plan limits saved contacts and messages per calendar month. Unused messages don't carry over.
  • Meta charges your WhatsApp Business account separately for template messages. Those fees aren't part of our plans.
  • Refunds are covered by our refund policy.

Suspension and closing your account

We may suspend or close accounts that break these terms, for example by messaging people who didn't opt in, or that put Pingodra or other customers at risk. You can delete your account at any time in Settings.

Service availability

We work to keep Pingodra running, but it's provided “as is”. Message delivery depends on Meta, and WhatsApp may limit, flag or block numbers based on your sending and your recipients' feedback. We aren't responsible for those decisions.

Liability

To the extent the law allows, we aren't liable for indirect or consequential losses, and our total liability to you is limited to the amount you paid us in the 3 months before the claim.

You agree to cover our losses from claims that arise because you messaged people without consent or otherwise broke these terms or the law.

Changes and governing law

We'll post changes to these terms here and update the date above. Continuing to use Pingodra means you accept them. These terms are governed by the laws of India.
